Before the Shoot
An appointment is considered booked when the Client and Photographer agree on a time and it is reserved on the Photographer's schedule.
The Client is responsible for ensuring the selected service package suits their needs and the property. Matara Media and its Photographers are not responsible if the chosen package does not provide adequate photographic coverage of a property. Cancellation, Re-Scheduling, No-Show, and Bad Weather
The Client is responsible for rescheduling the booking due to rain, snow, etc. In the event that it is raining or snowing during the shoot, it is solely left to the Photographer's discretion whether or not to expose their personal professional equipment to the elements. (Photographers do bring umbrellas, but exterior images are not guaranteed in wet weather).
If cancellation or re-scheduling is necessary, please do so with a minimum of 24 hours notice. Any booking cancelled less than 24 hours in advance of the confirmed appointment date/time is subject to Cancellation Fee of 50% of the cost of the package booked. Arriving late beyond 30 minutes to an appointment will be considered a 'no show', and will be billed at the full rate of the shoot. Every effort will be made to accommodate re-scheduling.
At the Shoot
The Client is responsible for the presence of an authorized representative at the shoot to approve the Photographer’s interpretation of the project. If a Client or Brokerage representative is not present, the Photographer’s interpretation shall be deemed acceptable. The photographer will make a reasonable effort (but is not required) to remove litter, stray objects, etc. Please note that this does not include things like making beds or arranging furniture. Agents are expected to have the property staging and cleaning completed prior to the photo shoot. All properties will be shot “As Is.” Your input is important when choosing the best rooms and angles to photograph. Absent your input, the photographer will use his/her best judgment and experience to decide how best to photograph the property.
Additional on-site time over the minutes associated with the photography package is not guaranteed, and will be billed at a rate of $25.00 per 15 additional minutes.
After the Shoot
After the images have been made, the photographer will perform digital retouching and deliver to you within 2 business days, unless otherwise specified. Delivery is made via a Dropbox link sent to the email address you supply. Images files intended for print will meet a minimum resolution of 4000 x 2667 pixels (suitable for print sizes up to 8” x 10”). Image files intended for web use will meet a minimum resolution of 1000 x 900 pixels. Additional retouching and post-processing beyond what is included with the photography package can be performed at a rate of $12.50 per 15 minutes.
Payment
Payment is due in-full within 48hrs after the shoot unless otherwise specified. If payment is not received within 48hrs after the shoot, images, video, and webpages will not be delivered to the Client until full payment is received.
Parking Reimbursement
The Client shall reimburse the Photographer if free or metered street parking is not available and the Photographer must use paid garage/lot parking.
Rights & Usage
Unless specified otherwise, the Photographer retains copyright of the photographs and video, and hereby grants the Client unlimited but non-exclusive rights to use or reproduce the photographs for the purposes of marketing the property for sale. Other use, including but not limited to: marketing material for a real estate agent (business cards, web site banners, etc.), builder, architect, designer, stager, etc. is prohibited without first consulting the Photographer.
Other
Matara Media, the service, the site and all other related Matara Media products and services are provided "as is" without any other warranties whatsoever. All other express, implied, and statutory warranties, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement, are expressly disclaimed. To the fullest extent permitted by law, Matara Media disclaims any warranties for the security, reliability, timeliness, and performance of this service.
Matara Media, it's affiliates, employees, officers, representatives, service providers and it's suppliers shall not be responsible for nor be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive or other damages arising out of or relating in any way to the site, the service, or information contained within the site, including, but not limited to, your downloading or uploading of any material or documents or your use of any application or functionality associated with the site or service, even if Matara Media has been advised of the possibility of such damages.
Your sole and exclusive remedy for failure to deliver a paid service or breach of any obligation with respect to a paid service shall be a refund of the amount paid for the specific paid service at issue and in no event shall Matara Media's liability for failure to deliver such item exceed such amount.
Matara Media reserves the right to make changes to it's Terms of Service and other information on this website at any time and without notice. Please refer to these Terms of Service when you book as they may change from time to time. Matara Media may attempt to notify clients of changes made to photo packages, fees, etc.
